Service Disclaimer

Last updated: July 6, 2026

This Service Disclaimer explains the nature, limitations, exclusions, and professional boundaries of the services provided by Digital Red Eyes ("we," "our," or "us"). This disclaimer applies to all website interface analysis, usability consulting, content accessibility evaluation, navigation review, written recommendations, communications, proposals, reports, and other advisory services provided by Digital Red Eyes.

By using our website, requesting information, purchasing a service, reviewing our materials, or entering into a service engagement with us, you acknowledge that you have read, understood, and accepted this Service Disclaimer.

Digital Red Eyes provides advisory and analysis-focused consulting services only. We do not provide software development, website hosting, cybersecurity testing, legal advice, financial advice, payment processing, or management of client information systems.

1. Advisory Nature of Services

Digital Red Eyes provides professional observations, usability analysis, interface review, content structure feedback, navigation recommendations, and related consulting guidance. Our services are intended to help clients better understand how their website interface, content structure, and user flows may be experienced by visitors.

Our deliverables are informational and consultative. They are not instructions that must be implemented exactly as written, and they are not a substitute for technical, legal, compliance, financial, accessibility certification, cybersecurity, or business-specific professional advice.

2. No Guarantee of Results

Although we aim to provide thoughtful, practical, and professionally prepared recommendations, Digital Red Eyes does not guarantee any specific outcome from the use of our services or implementation of our recommendations.

We do not guarantee:

  • Higher website conversion rates
  • Increased sales, revenue, leads, signups, or bookings
  • Improved search engine ranking or advertising performance
  • Higher customer satisfaction scores
  • Compliance with any specific legal, technical, industry, or accessibility standard
  • Acceptance by payment processors, platforms, partners, investors, regulators, or customers
  • Elimination of all usability problems, interface friction, or content clarity issues

Actual results depend on many factors outside our control, including implementation quality, technical limitations, market conditions, audience behavior, offer quality, pricing, website performance, branding, traffic source, competition, hosting environment, advertising strategy, and internal business execution.

3. Not Software Development or Website Building

Digital Red Eyes does not provide software development, website coding, custom application development, theme development, database development, plugin development, server configuration, or technical implementation services unless expressly stated in a separate written agreement.

Our reports may identify usability concerns, interface inconsistencies, navigation issues, or content clarity problems. However, responsibility for implementing any recommendations belongs to the client or the client's chosen development, design, marketing, or technical team.

4. Not Cybersecurity or Penetration Testing

Our services do not include cybersecurity testing, vulnerability scanning, penetration testing, malware removal, incident response, network security monitoring, password auditing, threat modeling, or security certification.

If a recommendation relates to user trust, form clarity, navigation safety, checkout confidence, or perceived credibility, that recommendation is based on usability and communication considerations only. It should not be interpreted as a cybersecurity assessment, technical security audit, or confirmation that a website is secure.

5. Not Legal, Regulatory, or Compliance Advice

Digital Red Eyes does not provide legal advice. Any comments we make about privacy notices, cookie banners, accessibility wording, checkout disclosures, policy placement, consumer-facing content, or legal-page visibility are general usability and communication observations only.

Clients are responsible for consulting qualified legal counsel regarding privacy laws, consumer protection laws, accessibility requirements, data protection obligations, advertising rules, payment processor requirements, industry regulations, and any other legal or compliance matter relevant to their business.

6. Not Financial, Tax, or Accounting Advice

Our services do not include financial planning, accounting, bookkeeping, tax preparation, investment advice, payment processing advice, chargeback management, or revenue forecasting. Any comments about pricing visibility, checkout clarity, service packaging, or conversion logic are based on interface and user experience considerations only.

Clients should consult appropriate financial, accounting, or tax professionals before making financial, tax, pricing, payment, or accounting decisions.

7. Not Accessibility Certification

Digital Red Eyes may provide content accessibility evaluation from a usability and readability perspective. This may include observations about text clarity, contrast perception, information hierarchy, page organization, heading structure, or ease of understanding.

However, we do not provide formal accessibility certification, WCAG compliance certification, legal accessibility audits, assistive technology testing, screen reader certification, ADA compliance determinations, or government accessibility compliance reports unless expressly agreed in writing with appropriate technical scope.

Any accessibility-related recommendations should be reviewed by qualified accessibility specialists or legal counsel if the client requires formal compliance verification.

8. Not Management of Client Systems

Digital Red Eyes does not manage, operate, control, host, monitor, or administer client websites, servers, accounts, databases, payment systems, customer records, analytics accounts, advertising accounts, or internal information systems.

Clients remain fully responsible for their own website operations, platform settings, account security, system access, customer data, hosting environment, user permissions, and technical vendors.

9. Client Responsibility for Implementation

Clients are solely responsible for deciding whether, when, and how to implement any recommendations provided by Digital Red Eyes. We encourage clients to review our recommendations internally and with appropriate technical, design, legal, compliance, or business professionals before implementation.

Digital Red Eyes is not responsible for errors, downtime, layout problems, lost data, reduced performance, user complaints, business disruption, or other issues caused by implementation decisions made by the client or third parties.

10. Information Provided by the Client

Our analysis may depend on information, access, documents, screenshots, URLs, content, analytics summaries, business descriptions, or explanations provided by the client. We rely on the accuracy and completeness of information supplied to us.

Digital Red Eyes is not responsible for inaccurate recommendations, incomplete analysis, delayed delivery, or misunderstood project context resulting from inaccurate, outdated, incomplete, misleading, or withheld client information.

11. Third-Party Platforms and Tools

Client websites may rely on third-party platforms, applications, themes, plugins, analytics tools, payment providers, hosting services, form providers, advertising platforms, or content management systems. Digital Red Eyes does not control these third-party systems and is not responsible for their availability, functionality, security, pricing, policies, limitations, or changes.

If our recommendations involve or reference a third-party platform feature, the client is responsible for confirming that the feature is available, appropriate, permitted, and technically feasible within the client's specific account, plan, configuration, and jurisdiction.

12. Professional Judgment and Subjectivity

Interface analysis and usability consulting involve professional judgment. Different consultants, designers, developers, marketers, and stakeholders may reasonably disagree about layout priorities, content hierarchy, design direction, navigation structure, or user experience strategy.

Our recommendations reflect our professional opinion based on the information available at the time of review. They should be treated as guidance, not as absolute rules or guaranteed solutions.

13. Time-Sensitive Nature of Recommendations

Our recommendations are based on the website, content, interface, market context, and information available at the time the service is performed. Websites and digital platforms can change quickly. A recommendation that is appropriate at one point in time may become outdated after redesigns, platform updates, new business goals, legal changes, audience shifts, or technical modifications.

Clients should periodically review their website and consult appropriate professionals before relying on older reports for current decisions.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Digital Red Eyes shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the use of our services, website, reports, recommendations, or communications.

This includes, without limitation, loss of revenue, loss of profits, loss of business opportunity, loss of customer data, reputational harm, website downtime, implementation errors, platform restrictions, legal claims, regulatory issues, or third-party disputes.

15. No Professional Relationship Beyond Agreed Scope

Use of our website, submission of an inquiry, receipt of general information, or review of public materials does not create a client relationship, consulting engagement, fiduciary duty, or professional obligation. A formal service relationship begins only when Digital Red Eyes accepts the engagement and the parties agree to the relevant service terms, proposal, invoice, or statement of work.

16. Updates to This Disclaimer

Digital Red Eyes may update this Service Disclaimer from time to time to reflect changes in our service offerings, business practices, platform environment, or legal requirements. The "Last updated" date at the top of this page indicates when the most recent revision was made.

Your continued use of our website or services after updates are posted constitutes acceptance of the revised Service Disclaimer.
